**Any purchase made using a payment method without the cardholder's explicit authorization is strictly prohibited and constitutes fraud. Such incidents will be reported to law enforcement authorities and the relevant payment card networks.**

- Share your license key with any other individual.

- Circumvent, disable, or interfere with any license management, authentication, or anti-piracy mechanisms.

Violation of any of these terms will result in immediate and permanent revocation of your license without refund.

## 7. Digital Delivery Policy


**All Digital Products are delivered electronically and automatically.**


- Upon successful payment, a unique License Key is generated automatically by our system and delivered to you via the order confirmation page and/or the email address you provided at checkout.
- Delivery of a Digital Product is considered **complete and fulfilled** at the moment the License Key is generated and made available to you, regardless of whether you choose to access, copy, activate, or use it.
- It is your sole responsibility to ensure that you provide a correct and accessible email address during checkout.
- We maintain automated, tamper-proof records of all digital deliveries, including timestamps, license keys generated, delivery method, and confirmation logs.


**By completing a purchase of a Digital Product, you acknowledge that delivery occurs instantly and that you waive any right to claim non-receipt once the license key has been generated and made available.**

## 8. Physical Product Shipping Policy


### 8.1 General Shipping Terms


Physical Products (DMA cards, fusers, and related hardware) are shipped to the address you provide at checkout. **It is your sole responsibility to provide a complete, accurate, and deliverable shipping address.** We are not responsible for delays, non-delivery, or returned shipments resulting from incorrect, incomplete, or undeliverable addresses provided by you.


### 8.2 Processing Times


- Orders are typically processed within **3 to 7 business days** after payment confirmation.
- Processing times are estimates and are not guaranteed. Delays may occur due to stock availability, high order volume, supplier lead times, quality control checks, or other operational factors.
- Processing time does not include shipping transit time.


### 8.3 Shipping Methods and Transit Times


- We ship via reputable international carriers (e.g., Royal Mail, DHL, FedEx, UPS, or equivalent).
- Estimated transit times vary by destination and shipping method selected. Typical international delivery estimates are **7 to 30 business days**, depending on the destination country and customs processing.
- **All shipping estimates are approximate and not guaranteed.** Transit times may be affected by factors beyond our control, including but not limited to: carrier delays, weather conditions, natural disasters, pandemics, public holidays, customs inspections, government actions, and force majeure events.
- Express or expedited shipping may be available at additional cost where offered.


### 8.4 Tracking Information


- A tracking number will be provided via email once your order has been shipped.
- It is your responsibility to monitor the tracking status of your shipment.
- Tracking information is provided by the shipping carrier, not by us. We are not responsible for inaccurate, delayed, or unavailable tracking updates from the carrier.
- Some shipments to certain countries may have limited or no tracking visibility once the package enters the destination country's postal system.


### 8.5 Transfer of Risk (Title and Risk of Loss)


**Title to and risk of loss for all Physical Products passes to you upon delivery of the item to the shipping carrier (the "point of shipment").** This means:


- Once the product has been handed over to the shipping carrier and a tracking number has been generated, the product is legally in your possession and under your risk.
- We are **not responsible** for any loss, theft, damage, destruction, delay, or misdelivery of the package that occurs **after** the product has been tendered to the shipping carrier.
- This includes, but is not limited to: packages lost in transit, packages stolen from your doorstep or mailbox ("porch piracy"), packages damaged during transit, packages delayed by the carrier, packages held or seized by customs, packages returned to sender by the carrier, and packages delivered to a wrong address due to carrier error.


### 8.6 Customs, Duties, Taxes, and Import Fees


- **All customs duties, import taxes, VAT, GST, brokerage fees, and any other charges imposed by your country's customs authorities are your sole responsibility.**
- We do not collect, prepay, or reimburse any import duties or taxes.
- We have no control over customs policies, import regulations, or the amount of duties charged in your country.
- Customs processing may cause additional delays in delivery. We are not responsible for any delays caused by customs inspections or processing.
- If you refuse to pay customs duties and the package is returned to us, you will not receive a refund. You may request re-shipment at your own expense, including any additional shipping and handling fees.
- We do not provide false customs declarations. Products will be declared at their actual purchase value.


### 8.7 Delivery Attempts and Unclaimed Packages


- It is your responsibility to be available to receive the package or to arrange for collection if a delivery attempt fails.
- If the carrier is unable to deliver the package after the standard number of delivery attempts, the package may be held at a local depot or post office for a limited period.
- If you fail to collect the package within the carrier's holding period, the package may be returned to us or destroyed by the carrier.
- We are **not responsible** for packages returned to us or destroyed due to your failure to collect them, failed delivery attempts, or incorrect address information.
- If a package is returned to us, you may request re-shipment at your own expense. We are not obligated to provide a refund in this situation.


### 8.8 Shipping Address Changes


- Shipping address changes can only be accommodated **before** the order has been shipped and a tracking number generated.
- Once a package has been tendered to the shipping carrier, we cannot modify, redirect, or recall the shipment. Any address change requests after shipment must be made directly to the carrier by you, at your own expense.


### 8.9 International Shipping Risks


You acknowledge that international shipping carries inherent risks, including but not limited to:


- Extended transit times (up to 60 days in some cases)
- Customs delays, inspections, and seizures
- Limited tracking visibility in certain countries
- Package damage during long-distance transit
- Carrier mishandling or misrouting
- Political instability, trade restrictions, or sanctions affecting delivery


**By placing an order for international delivery, you accept these risks and agree that delays or issues related to international shipping do not entitle you to a refund or chargeback.**

## 9. Refund and Cancellation Policy


### 9.1 Digital Products


**Due to the nature of digital software and instant electronic delivery, all sales of Digital Products are final. No refunds, returns, exchanges, or cancellations are offered under any circumstances**, including but not limited to:


- Accidental or duplicate purchases
- Change of mind or buyer's remorse
- Incompatibility with your hardware, software, or operating system
- Failure to read the product description or system requirements before purchasing
- Unsupported platforms, games, or game updates
- Dissatisfaction with the product's features or performance
- Inability to use the product due to third-party restrictions (e.g., game bans, anti-cheat detections, server-side updates)
- Loss of access to your email, Discord, or other account used during purchase
- Claims of non-delivery when our records confirm successful delivery


### 9.2 Physical Products


**All sales of Physical Products are final once the order has been shipped.** No refunds are offered for:


- Change of mind or buyer's remorse after purchase
- Incorrect shipping address provided by you
- Packages lost, stolen, or damaged in transit after transfer of risk to the carrier (see Section 8.5)
- Delays in delivery caused by carriers, customs, or force majeure events
- Customs duties, taxes, or fees that you were not expecting
- Refusal to accept delivery or pay customs charges
- Products seized or held by customs authorities
- Incompatibility with your setup, hardware, or intended use case
- Packages returned to us due to failed delivery attempts or unclaimed packages
- Minor cosmetic differences between the product and website images


### 9.3 Exceptions (Defective Products Only)


If a Physical Product arrives with a verifiable manufacturing defect that renders it non-functional, you must:


1. Contact us via Discord or email within **7 calendar days** of receiving the product.
2. Provide clear photographs or video evidence of the defect.
3. Provide the original order number and tracking information.


We will evaluate the claim and, at our sole discretion, may offer a replacement or store credit. **Refunds for defective products are issued only at our discretion and are not guaranteed.** We may require you to return the defective product at your expense before issuing a replacement.


The following are **not** considered defects:


- Normal wear and tear
- Damage caused by misuse, mishandling, improper installation, or modification
- Damage caused during shipping (see Section 8.5 — risk passes to you at point of shipment)
- Cosmetic imperfections that do not affect functionality
- Incompatibility with your hardware configuration
- Issues caused by third-party software, firmware, or hardware


### 9.4 Order Cancellation


- Orders for Digital Products cannot be cancelled once payment is processed, as delivery is instant.
- Orders for Physical Products may be cancelled only if the order has **not yet been shipped**. Once a tracking number has been generated and the product tendered to the carrier, the order cannot be cancelled.
- To request a cancellation, contact us immediately via Discord. Cancellation requests are processed on a best-effort basis and are not guaranteed.


**You are strongly encouraged to read all product descriptions, specifications, compatibility requirements, and these Terms carefully before completing your purchase.** If you have any questions about a product, contact us via Discord before purchasing.

## 10. Chargebacks and Payment Disputes


**Filing a fraudulent chargeback or payment dispute is a serious matter that may constitute criminal fraud.**


By completing a purchase on this website, you agree to the following:


### 10.1 Mandatory Pre-Dispute Resolution


If you have any issue with your purchase — whether related to a Digital Product or Physical Product — you **must** contact us directly through our official support channels (Discord or email) **before** initiating any chargeback, payment dispute, claim, or complaint with your bank, credit card company, payment processor, or any third party. We commit to responding to all inquiries within 48 hours.


**Failure to contact us before filing a dispute will be treated as evidence of bad faith and may be presented as such to the payment processor and issuing bank.**


### 10.2 Fraudulent Chargebacks — Digital Products


A chargeback filed for a Digital Product after the license key has been delivered, activated, downloaded, or the software has been used constitutes **first-party fraud (friendly fraud)** and will be treated as such. We maintain comprehensive server-side logs that independently verify delivery and usage.


### 10.3 Fraudulent Chargebacks — Physical Products


A chargeback filed for a Physical Product after the order has been shipped and a tracking number provided constitutes **first-party fraud (friendly fraud)** unless the cardholder's payment method was genuinely used by an unauthorized third party. The following chargeback claims are considered fraudulent when contradicted by our evidence:


- **"Item not received"** — when tracking shows delivery or delivery attempt
- **"Item not as described"** — when the product matches the published description and specifications
- **"Unauthorized transaction"** — when the cardholder's own name, email, phone, IP address, or billing information matches our order records
- **"Cancelled transaction"** — when no cancellation request was made before shipment
- **"Credit not processed"** — when no refund was requested or agreed upon
- **"Duplicate transaction"** — when only one charge exists for the order


### 10.4 Our Rights in Response to Chargebacks


In the event of any chargeback or payment dispute, we reserve the right to:


- Submit comprehensive evidence to the payment processor and issuing bank, including but not limited to: customer identification data, IP addresses, device fingerprints, delivery confirmations, shipping tracking records and proof of delivery, license activation records, software download and usage logs, customer communications, and any other relevant data.
- Permanently ban your account, license key(s), IP address, device identifiers, shipping address, and any associated identifiers from all current and future products and services.
- Report fraudulent chargebacks to fraud prevention databases and industry blacklists (e.g., MATCH list, Ethoca, Verifi).
- Pursue civil legal action to recover the disputed amount plus any and all associated fees, costs, penalties, and damages, including but not limited to: chargeback fees charged by our payment processor, legal fees and court costs, lost revenue and administrative costs.
- File a criminal fraud complaint with the relevant law enforcement agency in our jurisdiction and/or yours.
- Share relevant transaction data, identification information, and evidence with law enforcement agencies, payment networks (Visa, Mastercard), and fraud prevention organizations.
- Engage a collections agency to recover the disputed amount and associated costs.


### 10.5 Chargeback Fees and Cost Recovery


In the event that a chargeback is filed, regardless of outcome, you agree to be liable for any and all fees, penalties, fines, and administrative costs incurred by us as a result of the dispute process. This includes, but is not limited to:


- Payment processor chargeback fees (typically £15–£25 per dispute)
- Network assessment fees
- Administrative and evidence preparation costs
- Legal fees incurred in responding to the dispute


If the chargeback is reversed in our favor, you agree to reimburse all such costs upon demand.


### 10.6 Evidence Retention


We maintain detailed, timestamped records of all transactions for both Digital and Physical Products, including but not limited to:


**For all orders:**
- Full order details, timestamps, and order status history
- Customer identification data (name, email, phone, IP address, device information, browser fingerprint)
- Payment authorization codes, transaction IDs, and payment processor references
- All communications between the customer and our support team
- Customer feedback, reviews, and ratings
- Terms of Service acceptance records (timestamp and IP)


**Additionally for Digital Products:**
- License key generation and delivery records with timestamps
- License activation timestamps, user IDs, and device data
- Software download logs with IP addresses and timestamps
- Software login and usage logs with IP addresses, timestamps, and session data


**Additionally for Physical Products:**
- Shipping carrier name and service type
- Tracking number and full tracking history
- Proof of shipment (carrier acceptance scan)
- Proof of delivery (carrier delivery confirmation, signature if applicable)
- Package weight, dimensions, and declared value
- Customs declaration details
- Photographs of packaged items (when available)


All records are retained for a minimum of **36 months** from the date of purchase and may be used as evidence in any dispute, chargeback, arbitration, or legal proceeding.

## 11. Acknowledgment at Purchase


**By clicking "Pay," "Complete Purchase," "Place Order," or any equivalent button during checkout, you explicitly acknowledge and agree that:**


1. You have read, understood, and agree to these Terms of Service in their entirety.
2. You are the authorized holder of the payment method being used, or have explicit authorization from the cardholder.
3. All personal information, billing details, and shipping information (if applicable) you have provided are truthful, accurate, and complete.
4. **For Digital Products:** You are purchasing a digital product that will be delivered instantly and electronically. You understand that this purchase is non-refundable. You consent to immediate delivery and expressly waive any cancellation or "cooling-off" rights to the maximum extent permitted by applicable law.
5. **For Physical Products:** You understand that risk of loss transfers to you upon delivery to the shipping carrier (Section 8.5). You accept responsibility for customs duties and import fees (Section 8.6). You understand that shipping delays do not entitle you to a refund.
6. You will contact us directly before initiating any chargeback or payment dispute.
7. You will not file a fraudulent chargeback or payment dispute. You understand that doing so after receiving, activating, or using a product may constitute fraud and result in legal consequences.
8. You consent to the collection and use of your personal data as described in Section 4.

## 12. Shipping Insurance (Optional)


Where available at checkout, you may purchase optional shipping insurance to protect against loss or damage during transit.


- **If you purchase shipping insurance** and the package is confirmed lost or damaged by the carrier, we will file a claim with the insurance provider on your behalf. If the claim is approved, we will send a replacement or issue a refund at our discretion.
- **If you decline shipping insurance**, you accept full risk for loss or damage during transit as outlined in Section 8.5. No refund, replacement, or credit will be provided for uninsured packages that are lost, stolen, or damaged after the point of shipment.


Shipping insurance does not cover: customs seizures, packages refused by the recipient, incorrect addresses, or delays.

## 13. Force Majeure


We shall not be liable for any failure or delay in the performance of our obligations (including shipping, delivery, or service availability) where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

- Customs holds, inspections, or seizures by government authorities


In the event of a force majeure, we will make reasonable efforts to fulfill your order as soon as practicable. Force majeure events do not entitle you to a refund, chargeback, or cancellation.

All software is provided **"as-is"** and **"as-available"** without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

We make no guarantee that any product (digital or physical) will:


- Be compatible with your specific hardware, software, or system configuration
- Remain functional after third-party software updates, firmware changes, or game patches
- Be free from defects, errors, or interruptions
- Meet your specific expectations or requirements
- Remain available indefinitely

## 15. Limitation of Liability


We are not liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

- Service interruptions, downtime, or data breaches
- Shipping delays, losses, or damages after transfer of risk
- Customs seizures, duties, or import issues

**Your use of any product is at your sole risk.** You are fully responsible for how you choose to use our products and any consequences that arise from such use.


**Our total aggregate liability to you for any and all claims arising from or related to these Terms, your purchases, or your use of our products and services shall not exceed the total amount you paid for the specific product(s) giving rise to the claim.**

- Any chargeback or payment dispute you initiate
- Any false, misleading, or fraudulent information you provide
- Any claim by a third party related to your use of our products


This indemnification obligation shall survive the termination of these Terms and the completion of any transaction.

2. **Response Period:** We will acknowledge your inquiry within 48 hours and provide a substantive response within 7 business days.
3. **Negotiation:** Both parties agree to negotiate in good faith for a period of 30 days from the date of initial contact.
4. **Formal Action:** Only after the 30-day negotiation period has expired without resolution may either party pursue formal legal action.


This dispute resolution procedure does not apply to urgent matters requiring injunctive relief.

## 25. Severability
