## 1. General Policy
**All sales on ambient-dma.com are final.** We do not offer refunds, returns, exchanges, or cancellations except as explicitly stated in this policy.
We sell two categories of products:
- **Digital Products** — Software licenses, license keys, and digital tools delivered electronically.
- **Physical Products** — Hardware items including DMA cards, fusers, firmware devices, PCIe devices, and related accessories.
Each category has specific refund terms detailed below.

## 2. Digital Products — No Refunds
**Due to the nature of digital software and instant electronic delivery, all sales of Digital Products are final and non-refundable.**
Once payment is processed, your license key is generated and delivered automatically and instantly. Because the product is delivered immediately in full, it cannot be "returned."
### No refunds will be issued for:
- Accidental or duplicate purchases
- Change of mind or buyer's remorse
- Incompatibility with your hardware, software, operating system, or system configuration
- Failure to read the product description, system requirements, or compatibility information before purchasing
- Unsupported platforms, games, or game updates that occur after purchase
- Dissatisfaction with the product's features, performance, or functionality
- Inability to use the product due to third-party restrictions, including but not limited to: game bans, anti-cheat detections, server-side updates, or platform policy changes
- Loss of access to your email, Discord account, or other account used during purchase
- Claims of non-delivery when our records confirm the license key was generated and made available
- Software downtime, updates, or temporary service interruptions
- Third-party software or hardware conflicts
- User error during installation, activation, or use
### Delivery Confirmation
Delivery of a Digital Product is considered complete at the moment the license key is generated and made available to you, regardless of whether you access, copy, or activate it. Our system maintains automated, timestamped records of all deliveries.
### Waiver of Cooling-Off Rights
By purchasing a Digital Product, you consent to immediate delivery and expressly waive any statutory cancellation or "cooling-off" rights (including those under the UK Consumer Contracts Regulations 2013 or EU Consumer Rights Directive) to the maximum extent permitted by applicable law.

## 3. Physical Products — No Refunds After Shipment
**All sales of Physical Products are final once the order has been shipped.**
### 3.1 No Refunds After Shipment
Once your order has been shipped and a tracking number has been generated, no refunds will be issued for any reason, including but not limited to:
- Change of mind or buyer's remorse
- Incorrect, incomplete, or undeliverable shipping address provided by you
- Packages lost in transit after handover to the shipping carrier
- Packages stolen after delivery (including "porch piracy")
- Packages damaged during transit
- Delays in delivery caused by shipping carriers, customs processing, weather, or any other factor
- Customs duties, import taxes, VAT, or brokerage fees that you did not expect or wish to pay
- Refusal to accept delivery or pay customs charges, resulting in the package being returned
- Products seized, held, or confiscated by customs authorities
- Incompatibility with your hardware, setup, or intended use case
- Packages returned to us due to failed delivery attempts or unclaimed packages
- Minor cosmetic differences between the product received and product images on the website
### 3.2 Transfer of Risk
Title to and risk of loss for all Physical Products passes to you upon delivery of the item to the shipping carrier. Once the carrier has the package and a tracking number has been generated, the product is your responsibility. Please refer to Section 7.5 of our Terms of Service for full details.
### 3.3 Customs and Import Fees
All customs duties, import taxes, VAT, GST, and brokerage fees are your sole responsibility. We do not refund any amounts related to customs charges. If you refuse to pay customs fees and the package is returned to us, no refund will be issued.
### 3.4 Pre-Shipment Cancellation
If your order has **not yet been shipped** (no tracking number generated), you may request a cancellation by contacting us immediately via Discord. Pre-shipment cancellation requests are processed on a best-effort basis and are not guaranteed. If approved, a refund will be issued to the original payment method.

## 4. Defective Physical Products
If a Physical Product arrives with a verifiable manufacturing defect that renders it completely non-functional, you may be eligible for a replacement or store credit (not a refund) under the following conditions:
### 4.1 Requirements
1. You must contact us via Discord or email within **7 calendar days** of receiving the product.
2. You must provide:
- Your original order number
- Tracking number confirming delivery
- Clear photographs or video evidence showing the defect
- A description of the issue and the steps you took before determining the product is defective
3. You must not have modified, tampered with, or physically damaged the product.
### 4.2 Our Response
We will evaluate your claim within **7 business days**. At our sole discretion, we may:
- Request additional evidence or information
- Offer a replacement product (you may be required to return the defective item at your expense)
- Offer store credit equivalent to the purchase price
- Determine that the product is not defective and decline the claim
**Cash refunds for defective products are issued only in exceptional circumstances and entirely at our discretion.**
### 4.3 What Is NOT Considered a Defect
The following do not qualify as manufacturing defects and will not be eligible for any replacement, credit, or refund:
- Normal wear and tear from use
- Damage caused by misuse, mishandling, drops, liquid exposure, or physical force
- Damage caused by improper installation, incorrect wiring, or incompatible hardware
- Damage caused by modifications, soldering, firmware flashing, or unauthorized alterations
- Damage caused during shipping (risk transfers at point of shipment — see Section 3.2)
- Cosmetic imperfections (scratches, color variations, label placement) that do not affect functionality
- Incompatibility with your specific hardware, motherboard, chipset, or configuration
- Issues caused by third-party software, firmware, drivers, or hardware
- Performance that does not meet your subjective expectations
- Products that functioned correctly but later failed due to misuse or external factors

## 5. Shipping Insurance
Where available at checkout, you may purchase optional shipping insurance.
- **If you purchased shipping insurance** and the package is confirmed lost or damaged by the carrier (with carrier confirmation), we will file a claim with the insurance provider on your behalf. If the claim is approved, we will send a replacement or issue a refund at our discretion.
- **If you did not purchase shipping insurance**, you accept full risk for loss or damage in transit. No refund, replacement, or credit will be provided.
Shipping insurance does not cover:
- Customs seizures or confiscation
- Packages refused by the recipient
- Incorrect shipping addresses provided by you
- Delivery delays

## 6. Chargebacks Are Not Refunds
**A chargeback is NOT a legitimate refund method.** If you have an issue with your purchase, you must contact us first.
Filing a chargeback or payment dispute with your bank or payment processor instead of contacting us directly is a violation of our Terms of Service and may constitute fraud.
If you file a chargeback after your product has been delivered, activated, or shipped, we will:
- Submit comprehensive evidence to the payment processor and your bank
- Permanently ban you from all products and services
- Report the incident to fraud prevention databases
- Reserve the right to pursue legal action for recovery of the disputed amount and all associated fees
